Jedna uobi\u010dajena opcija je <strong>sporazumni raskid ugovora o radu<\/strong>, \u010desto nazivan \u201esporazumna odpoved\u201c na slovena\u010dkom. Ovo omoguc\u0301ava i zaposlenom i poslodavcu da se dogovore o prekidu radnog odnosa pod uslovima koje zajedno utvrde.<\/p><\/p>\n\n<p class=\" eplus-wrapper\">Sporazumni raskid se obi\u010dno koristi kada obe strane \u017eele da se radni odnos zavr\u0161i brzo i sporazumno, bez potrebe za dugotrajnim postupcima. U nastavku obja\u0161njavamo ko mo\u017ee da predlo\u017ei takav sporazum, kako proces funkcioni\u0161e i \u0161ta treba uzeti u obzir pre potpisivanja.<\/p>\n\n<p class=\" eplus-wrapper\"><p><strong>Ko mo\u017ee da predlo\u017ei sporazumni otkaz?<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\">I zaposleni i poslodavac mogu da predlo\u017ee sporazumni prekid radnog odnosa.<\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-218bcb\">\n<li class=\" eplus-wrapper\">U praksi se predlog \u010desto daje usmeno.<\/li>\n\n\n\n<li class=\" eplus-wrapper\"><p>Me\u0111utim, toplo se preporu\u010duje da se podnese i u <strong>pisanoj formi<\/strong> radi jasnoc\u0301e i vo\u0111enja evidencije.<\/p><\/li>\n<\/ul>\n<p class=\" eplus-wrapper\"><p><strong>Potpisivanje sporazumnog sporazuma o prekidu radnog odnosa<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\"><p>Ako se obe strane sla\u017eu, moraju da sastave i potpi\u0161u pisani sporazum o prekidu ugovora o radu.<\/p><\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-aa01fa\">\n<li class=\" eplus-wrapper\">Sporazumni prekid je va\u017eec\u0301i samo ako je u pisanoj formi.<\/li>\n\n\n\n<li class=\" eplus-wrapper\"> Sporazum mora da sadr\u017ei sva zakonski propisana upozorenja i izjave o posledicama otkaza, posebno u vezi sa pravima zaposlenog na naknadu za nezaposlenost od Zavoda za zapo\u0161ljavanje Slovenije (ZRSZ).<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Bez ovih upozorenja, sporazum je neva\u017eec\u0301i.<\/li>\n<\/ul>\n<p class=\" eplus-wrapper\"><p><strong>\u0160ta ako sporazum nije moguc\u0301?<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\">Me\u0111usobni otkaz funkcioni\u0161e samo ako se obe strane sla\u017eu.<\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-a529f5\">\n<li class=\" eplus-wrapper\">Ako jedna strana odbije, radni odnos se nastavlja.<\/li>\n\n\n\n<li class=\" eplus-wrapper\"><p>Strana koja tra\u017ei otkaz mo\u017ee tada da nastavi sa <strong>redovnim jednostranim prekidom <\/strong>ugovora o radu, bilo od strane zaposlenog ili od strane poslodavca, u zavisnosti od situacije.<\/p><\/li>\n<\/ul>\n<p class=\" eplus-wrapper\"><p><strong>Otkazni rok i opcije skrac\u0301ivanja<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\"><p>Jedan od glavnih razloga za\u0161to zaposleni i poslodavci preferiraju sporazumni prekid jeste da <strong>izbegnu ili skrate otkazni rok.<\/strong><\/p><\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-54bd5a\">\n<li class=\" eplus-wrapper\">U me\u0111usobnom sporazumu, strane mogu da odlu\u010de da skrate ili \u010dak potpuno ukinu otkazni rok.<\/li>\n\n\n\n<li class=\" eplus-wrapper\">\u010cak i kod jednostranog otkaza, otkazni rok se mo\u017ee skratiti ako obe strane potpi\u0161u poseban sporazum koji pokriva samo skrac\u0301eni period.<\/li>\n<\/ul>\n<p class=\" eplus-wrapper\"><p><strong>Klju\u010dna razmatranja za zaposlene<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\">Pre potpisivanja sporazuma o me\u0111usobnom otkazu, zaposleni \u2013 posebno strani radnici \u2013 treba pa\u017eljivo da razmotre posledice:<\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-d3c573\">\n<li class=\" eplus-wrapper\"><p><strong>Naknade za nezaposlenost<\/strong>: Potpisivanje sporazumnog otkaza mo\u017ee uticati na va\u0161u kvalifikovanost. Mo\u017eda nec\u0301ete ispunjavati uslove za punu naknadu za nezaposlenost u pore\u0111enju sa otkazom od strane poslodavca.<\/p><\/li>\n\n\n\n<li class=\" eplus-wrapper\"><p><strong>Dozvole za boravak i rad<\/strong>: Za strane ljude koji rade u Sloveniji, status zaposlenja \u010desto direktno uti\u010de na dozvole boravka.
