Direktiva o transparentnosti plata (Direktiva EU 2023\/970), usvojena 6. juna 2023. godine, uvodi obaveze koje c\u0301e fundamentalno promeniti na\u010din na koji kompanije pristupaju strukturama plata, praksi zapo\u0161ljavanja i internom izve\u0161tavanju.<\/p>\n\n<p class=\" eplus-wrapper\"><p>Dr\u017eave \u010dlanice moraju da transponuju direktivu u nacionalno zakonodavstvo do 7. juna 2026. godine. Kada stupi na snagu, zahtevac\u0301e zna\u010dajne promene od poslodavaca, posebno onih sa 100 ili vi\u0161e zaposlenih.<\/p><\/p>\n\n<p class=\" eplus-wrapper\"><p><strong>Klju\u010dni ciljevi<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\">Direktiva ima za cilj:<\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-ee9732\">\n<li class=\" eplus-wrapper\">Smanjenje neopravdanih razlika u platama.<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Oja\u010danje prava na jednaku platu za jednak rad.<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Pobolj\u0161anje pristupa informacijama o platama za radnike.<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Povec\u0301anje odgovornosti poslodavaca.<\/li>\n<\/ul>\n<p class=\" eplus-wrapper\">Ona pru\u017ea alate radnicima za upore\u0111ivanje plata i zahtevanje pravedan tretman, dok istovremeno podsti\u010de kompanije da identifikuju i re\u0161e strukturne nejednakosti.<\/p>\n\n<p class=\" eplus-wrapper\"><p><strong>\u0160ta poslodavci moraju da otkriju<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\"><p><strong>Informacije o platama za osobe koje tra\u017ee posao<\/strong><\/p><\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-313c34\">\n<li class=\" eplus-wrapper\"><p>Poslodavci moraju da obaveste kandidate za posao o <strong>po\u010detnoj plati ili rasponu plate<\/strong> za odre\u0111eno radno mesto.<\/p><\/li>\n\n\n\n<li class=\" eplus-wrapper\"><p>Ove informacije moraju biti zasnovane na <strong>objektivnim, rodno neutralnim kriterijumima.<\/strong><\/p><\/li>\n\n\n\n<li class=\" eplus-wrapper\"><p>U nekim zemljama, ovo mo\u017ee biti <strong>direktno<\/strong> zahtevano u <strong>oglasima za posao.<\/strong><\/p><\/li>\n<\/ul>\n<p class=\" eplus-wrapper\"><p><strong>Interna transparentnost<\/strong><\/p><\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-01ce33\">\n<li class=\" eplus-wrapper\"><p>Poslodavci moraju da obezbede <strong>lak pristup<\/strong> informacijama o kriterijumima za odre\u0111ivanje plata, nivoima plata i putevima napredovanja plata.<\/p><\/li>\n\n\n\n<li class=\" eplus-wrapper\"><p>Svi kriterijumi moraju biti <strong>objektivni i rodno neutralni<\/strong>.<\/p><\/li>\n<\/ul>\n<p class=\" eplus-wrapper\"><p><strong>Pravo na zahtev za podatke o platama<\/strong><\/p><\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-4ecce0\">\n<li class=\" eplus-wrapper\"><p>Zaposleni c\u0301e imati pravo da dobiju pisane informacije o:<\/p><\/li>\n<\/ul>\n<p class=\" eplus-wrapper\">Svom individualnom nivou plate.<\/p>\n\n<p class=\" eplus-wrapper\"><p><strong>Prose\u010dnim nivoima plata po polu <\/strong>za radnike koji obavljaju isti ili ekvivalentan posao.<\/p><\/p>\n\n<p class=\" eplus-wrapper\">Zaposleni nec\u0301e moc\u0301i da pristupe podacima o odre\u0111enim kolegama, vec\u0301 samo o grupisanim prose\u010dnim brojkama.<\/p>\n\n<p class=\" eplus-wrapper\"><p><strong>Otkrivanje plata izme\u0111u kolega<\/strong><\/p><\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-4d43a2\">\n<li class=\" eplus-wrapper\"><p>Poslodavci <strong>ne smeju da ograni\u010davaju zaposlene<\/strong> da dobrovoljno dele svoje podatke o platama ako to \u010dine kako bi ostvarili svoje pravo na jednaku platu.<\/p><\/li>\n\n\n\n<li class=\" eplus-wrapper\">Klauzule o poverljivosti koje to spre\u010davaju vi\u0161e nec\u0301e va\u017eiti.<\/li>\n<\/ul>\n<p class=\" eplus-wrapper\"><p><strong>Obaveze izve\u0161tavanja na osnovu veli\u010dine kompanije<\/strong><\/p><\/p>\n\n<figure class=\" wp-block-table eplus-wrapper\"><table class=\"has-fixed-layout\"><thead><tr><td><p><strong>Veli\u010dina kompanije<\/strong><\/p><\/td><td><p><strong>Rok izve\u0161tavanja<\/strong><\/p><\/td><td><p><strong>U\u010destalost<\/strong><\/p><\/td><\/tr><\/thead><tbody><tr><td>250+ zaposlenih<\/td><td>do 7. Juna 2031<\/td><td>svake 3 godine<\/td><\/tr><\/tbody><\/table><\/figure>\n\n<p class=\" eplus-wrapper\"><p><strong>Obavezni sadr\u017eaj izve\u0161taja obuhvata:<\/strong><\/p><\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-a863af\">\n<li class=\" eplus-wrapper\">Razlika u platama izme\u0111u polova (srednja vrednost i te\u017ei\u0161na linija)<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Razlika u bonusima i varijabilnim platama<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Udeo \u017eena i mu\u0161karaca koji primaju bonuse<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Raspodela plata po kvartilima po polu<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Razlika u platama izme\u0111u polova po kategoriji posla<\/li>\n<\/ul>\n<p class=\" eplus-wrapper\"><p>Ako prose\u010dna razlika u platama izme\u0111u polova u bilo kojoj kategoriji plata prelazi <strong>5%<\/strong> i <strong>nije objektivno opravdana ili ispravljena u roku od 6 meseci<\/strong>, poslodavac mora da sprovede <strong>zajedni\u010dku procenu plata<\/strong> sa predstavnicima zaposlenih.<\/p><\/p>\n\n<p class=\" eplus-wrapper\"><p><strong>Sprovo\u0111enje i kazne<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\"><p>Svaka dr\u017eava \u010dlanica mora da usvoji <strong>efikasne, srazmerne i odvrac\u0301ajuc\u0301e kazne<\/strong> za nepo\u0161tovanje propisa. To mo\u017ee da uklju\u010duje:<\/p><\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-e483cc\">\n<li class=\" eplus-wrapper\">Administrativne nov\u010dane kazne<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Naknadu \u0161tete pogo\u0111enim zaposlenima<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Objavljivanje prekr\u0161aja<\/li>\n<\/ul>\n<p class=\" eplus-wrapper\"><p>Radnicima se tako\u0111e mora omoguc\u0301iti <strong>pristup pravnim sredstvima<\/strong>, uklju\u010dujuc\u0301i:<\/p><\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-41bc9e\">\n<li class=\" eplus-wrapper\">Pravne postupke<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Podr\u0161ku tela za ravnopravnost<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Prebacivanje tereta dokazivanja na poslodavca u slu\u010dajevima spora<\/li>\n<\/ul>\n<p class=\" eplus-wrapper\"><p><strong>Tehni\u010dka i administrativna podr\u0161ka<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\"><p>Direktiva zahteva od vlada da obezbede <strong>tehni\u010dku infrastrukturu<\/strong> za podr\u0161ku uskla\u0111enosti. To mo\u017ee da uklju\u010duje:<\/p><\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-8e04a7\">\n<li class=\" eplus-wrapper\">\u0160ablone i smernice<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Alate za procenu plata<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Kori\u0161c\u0301enje postojec\u0301ih administrativnih podataka (npr. poreskih ili evidencija socijalnog osiguranja) za prac\u0301enje razlika u platama<\/li>\n<\/ul>\n<p class=\" eplus-wrapper\">U Sloveniji se o\u010dekuje da postojec\u0301i REK obrasci ili sli\u010dni podnesci o platnom spisku mogu \u010diniti osnovu za izve\u0161tavanje.<\/p>\n\n<p class=\" eplus-wrapper\"><p><strong>Trenutna pravna situacija u Sloveniji<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\"><p>Slovena\u010dki zakon trenutno zabranjuje diskriminaciju na osnovu pola, uklju\u010dujuc\u0301i diskriminaciju u platama. Me\u0111utim,<strong> ne postoji sistemski okvir za transparentnost plata.<\/strong><\/p><\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-466d3d\">\n<li class=\" eplus-wrapper\">Nema obaveze otkrivanja raspona plata pre zapo\u0161ljavanja<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Nema zahteva za izve\u0161tavanje za poslodavce sa preko 100 zaposlenih<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Nema prava na pristup nivoima plata za uporedive pozicije<\/li>\n<\/ul>\n<p class=\" eplus-wrapper\"><p>Slovenija mora da implementira direktivu do <strong>7. juna 2026.<\/strong> godine, u suprotnom c\u0301e se direktno sprovo\u0111enje primenjivati samo u slu\u010dajevima vezanim za dr\u017eavu.<\/p><\/p>\n\n<p class=\" eplus-wrapper\"><p><strong>Strate\u0161ke implikacije za preduzec\u0301a<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\">Kompanije koje posluju u EU trebalo bi da se pripreme:<\/p>\n<ul class=\" wp-block-list eplus-wrapper eplus-styles-uid-246dc1\">\n<li class=\" eplus-wrapper\">Pregledom i a\u017euriranjem struktura plata<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Definisanjem jasnih, neutralnih kriterijuma za unapre\u0111enja i povec\u0301anja plata<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Obukom timova za ljudske resurse i pravnih timova o novim pravilima<\/li>\n\n\n\n<li class=\" eplus-wrapper\">Uspostavljanjem internih sistema za prikupljanje i izve\u0161tavanje o podacima o platama<\/li>\n<\/ul>\n<p class=\" eplus-wrapper\">Multinacionalne korporacije mogu da izaberu da primene dosledne politike na svim lokacijama u EU, bez obzira na nacionalne razlike.<\/p>\n\n<p class=\" eplus-wrapper\"><p><strong>Slovenija<\/strong><\/p><\/p>\n\n<p class=\" eplus-wrapper\"><p>Slovenija je vec\u0301 jedna od najravnopravnijih zemalja na svetu. U 2024. godini, razlika u platama izme\u0111u polova iznosila je 5%, \u0161to zna\u010di da su \u017eene zara\u0111ivale u proseku 95% bruto satnice mu\u0161karaca. Prema podacima Evrostata, GINI koeficijent Slovenije iznosio je <strong>23,6 u 2023<\/strong>. godini, \u0161to je jedan od najni\u017eih u EU, \u0161to ukazuje na visok nivo jednakosti prihoda.<\/p><\/p>\n\n<p class=\" eplus-wrapper\">Direktiva o transparentnosti plata re\u0161ava preostale praznine smanjenjem informacionih asimetrija i pru\u017eanjem zaposlenima ja\u010dih alata za zahtevanje jednake plate za jednak rad.<br\/><br\/><\/p>\n\n<p class=\" eplus-wrapper\"><p>Za poslodavce, ovo zna\u010di vec\u0301u transparentnost i odgovornost.
